Limited Warranty

The ASSESS Expert System and related documentation are provided "as is" without warranty of any kind, either expressed or implied, including, but not limited to the implied warranties of merchantability and fitness for a particular purpose.

The entire risk as to the quality and performance of the software system, licensed programs and related documentation is with the licensee. Should the software system, licensed programs and related documents or any portion thereof prove defective, the licensee assumes the entire cost of all necessary servicing, repair or correction.

Some states do not allow the exclusion of implied warranties, so the above exclusion may not apply to the licensee. This warranty gives the licensee specific legal rights and the licensee may also have other rights which vary from state to state. This entire statement is governed by the laws of the state of Texas.
